Session on Tuesday, September 08, 2015 at 9:00 a.m., date and time duly
posted.

Item #7: Motion was made by Stewart and seconded by Whitehouse to sign
Resolution#2015-87 designating certain unused real property of the County as
unneeded for Courthouse or Jail purposes and requesting the Judge of the
District Court of Creek County to appoint three disinterested freeholders of
the County to appraise said real estate so that it may be sold. The subject
property is described as: the South 40’ of NW/4 of NE/4 in Section 34, T19N,
R9E. This property is located on the west side of S. 313th W. Ave. S. of
Mannford, OK-Barbara Carson. Vote as follows: Stephens – Aye, Whitehouse –
Aye, Stewart – Aye.
Item #8: Motion was made by Stewart and seconded by Whitehouse to sign
detention contract between Kiowa County and Creek County Juvenile Justice
Detention Center. Vote as follows: Stephens – Aye, Whitehouse – Aye, Stewart
– Aye.
Item #9: Motion was made by Stewart and seconded by Whitehouse to sign
Jail Services Agreement between Oklahoma Department of Corrections, Tulsa
County District Community Correction and Creek County Criminal Justice
Center. This item was on a June 22, 2015 agenda stated Don Turner,
Undersheriff Company is requesting additional signed copies. Vote as follows:

Item #10: Motion was made by Stewart and seconded by Whitehouse to sign
proposed interest drilling royalties in Section 2, T15N, R7E between American
Energy-Woodford, LLC and BOCC. Vote as follows: Stephens – Aye, Whitehouse –
Aye, Stewart – Aye.
Item #11: Motion was made by Stewart and seconded by Whitehouse to
approve Utility Permit per County Spec’s from ONG for ¾” natural gas pipeline
by boring, size of line ¾” to cross S. 155th W. Ave approximately 2.97 miles
W. & 4.28 miles N. of the US HWY 44 & SH 97 and further described as 1983’ E.
& 508’ S. of the NW corner of Section 5, T18N, R11E. Vote as follows:

Item #12: Motion was made by Whitehouse and seconded by Stewart to
accept and approve the petition for S. 299th W. Ave Rural Road Development-
Bing Gann. Stephens stated that the list had been verified by Joy Naifeh,
Election Board Secretary. This item will be on next week’s agenda for the
additional information needed to proceed with the Rural Road Development.

Item #13: Motion was made by Stewart and seconded by Whitehouse to
accept and pass Bid#16-3 3 Month Bride/HWY Material for one week until
September 14, 2015 for review. Bids submitted by: Quapaw Company; Vance Bros
Inc.; Asphalt Fuel & Supply; Dunham’s Asphalt Services Inc.; Tulsa Asphalt
LLC; Apac-Central Inc.; Calumet Specialty Products LP. and Ergon Asphalt.

Item #14: Motion was made by Stewart and seconded by Whitehouse to
accept and award Bid#16-2 Dental Chair W/Light to Mannford Family Dentistry
for $300.00 per recommendation of Pat Danner, Health Department. Only bid
submitted. Vote as follows: Stephens – Aye, Whitehouse – Aye, Stewart – Aye.
Item #15: DISCUSSION ONLY/NO ACTION the possible placement of West 61st
Street South starting at South 401st West Ave. 96.440760—-36.075662 and
ending at South 385th West Ave 96.423032—-36.075731on the county highway
system as defined in 69 O.S. § 601 et sec, for possible maintenance by Creek
County Road District #2.Commissioner Rick Stewart (D2). Stewart stated he had
been told that Olive School bus will be traveling down the road. Stewart
stated he didn’t want to lose the work that was recently done to the road.
ODOT proposed on the map that this road was to be added to the maintenance
system. A motion was made by Stewart to place road on maintenance system.
Stephens and Whitehouse both were concerned with this road being up to
Minimum Road Standards.
Item #16: DISCUSSION ONLY/NO ACTION on the possible placement of South
119th West Ave starting at 96.127124—36.067723 and ending at 96.125930—
36.065075 on the county highway system as defined in 69 O.S. § 601 et sec,
for possible maintenance by Creek County Road District #2.Commissioner Rick
Stewart (D2. Stewart stated that this is a road is in Rustling Oaks 1
Addition. The County had accepted the plat but never accepted the roads. A
motion was made by Stewart to accept the roads to be county maintained.
Stephens asked if the road meet the County Spec’s and Stewart stated he was
unsure. Stephens advised of the process of petitioning the Board if the road
meets the spec’s.
Item #17: DISCUSSION ONLY/NO ACTION on the possible placement of West
103rd Street South starting at South 241st West Ave 96.261994–36.014034 and
ending at South 240th West Ave 96.260865—36.013947 in The Woodlands on the
county highway system as defined in 69 O.S. § 601 et sec, for possible
maintenance by Creek County Road District #2.Commissioner Rick Stewart (D2.
Items 17-22 were heavy discussed with the Board and Lee Whitaker, Larry
Whitaker, Rocky Spears, Kevin Wilson, Mannford Dobson, Ronald Dover, William
Adams, Kenneth Moody, J.D. Deckard stated there are 75 homes in addition and
they were told to build there road and the County would then maintain it. The
roads are now detreated with pot holes they need the Counties help. They have
been dealing with this for 15 years many residents stated and still have not
got the County to maintain the road. Rocky Spears provided the Board with
Statue 69 Section 601.5. Stephens stated the Board would need a core sample
to make sure the road was initially built to spec. Residents asked if the
core sample was going to have to be done then also take a core sample from
241st were the roads were built around the same time. Stephens also stated
that we need to verify if the roads are dedicated to the public.

Acres ) as on the county highway system as defined in 69 O.S. § 601 et sec,
for possible maintenance Creek County Road District #2.Evelyn Acheson, Linda
Rogers. Stephens asked if the following roads meet the County Spec’s. This
item was also heavily discussed with the Board and residents Evelyn Acheson,
Linda Rogers, Jackie Stout, J.D. Deckard and Mary Deckard asking if the
County would take the roads to be County Maintained. Residents stated that
the roads are in very bad shape. Stewart stated that the roads were dedicated
to the public and he has read through the minutes of 12-15-1986, 4-23-1984,
3-30-1987, 7-31-1985. Stewart verified with the residents present and Linda
Rogers that had attend past meeting that the following was stated:
Commissioner stated that appropriate action would be taken, Commissioner was
committed to working on the roads, Commissioner was directed to work on the
roads by D.A. Stewart stated that 1989 ODOT stated the County officially
approved putting the roads on the maintenance system. The Board stated they
would need time to review the minutes and read them to get more information.
Stephens asked about the Rural Road Improvement District and Homeowners
Association that was previously in place. Also, that he would not feel
comfortable at this time to take any action until the ongoing litigation is
resolved. Mrs. Jackie Stout stated that in the past the Commissioner was
working with Creek Nation to repair W. Hickory Dr. the Board did not accept
the help in a meeting.

Item #28: Motion was made by Stewart and seconded by Whitehouse to
approve ROW to be turned into ODOT for review. The request the District
Attorney’s approval of the County’s request for assistance of the Oklahoma
Department of Transportation legal department on proposed eminent domain
action on property owned by the Naifeh Family Revocable Trust located on W.
81st St. between Frankoma Road and HWY 97-Commissioners Rick Stewart(D2). Mr.
Goforth stated he had spoken to Max Cook, District Attorney and they are okay
with moving forward with ODOT. Vote as follows: Stephens – Aye, Whitehouse –
Aye, Stewart – Aye.

Item #27: Motion was made by Stewart and seconded by Whitehouse to
recess to attend Excise Board Budget Meeting held on Thursday, September 10,
2015 and Friday, September 11, 2015. Vote as follows: Stephens – Aye,

Chairman Stephens called the meeting back to order at 9:30 A.M. with
Commissioners Stephens, Whitehouse and Stewart present, The BOCC met in joint
session with the Creek County Excise Board, Elected Officials and Department
Heads to discuss the Estimate of Needs for FY 2015-2016. A motion was made by
Stewart and seconded by Whitehouse to meet in joint session. Vote as follows:
Stephens – Aye, Whitehouse – Aye, Stewart – Aye. A motion was made by Stewart
and seconded by Stephens to recess for 15 minute break at 10:21 a.m. Vote as
follows: Stephens – Aye, Whitehouse – Aye, Stewart – Aye. A motion was made
by Stewart and seconded by Whitehouse to reconvene joint session meeting.
